Welcome to BUDMO (“BUDMO”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of https://budmonft.com, including our NFT collection, online store, community platforms, digital services, and all related features (collectively, the “Services”).

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age and legally capable of entering into binding agreements under the laws applicable in your jurisdiction.

By using our Services, you represent and warrant that you meet these requirements.

2. Acceptance of Risk

Blockchain technology involves inherent risks.

By purchasing or interacting with BUDMO NFTs, you acknowledge and accept that:

  • Cryptocurrency values are highly volatile.
  • Blockchain transactions are irreversible.
  • Gas fees are non-refundable.
  • Smart contract failures, blockchain congestion, network upgrades, hacks, wallet compromises, or technical failures may occur.
  • We cannot reverse or modify blockchain transactions once confirmed.

You assume all risks associated with your use of blockchain technology.

3. NFT Purchases

All NFT sales are final.

Because NFTs are blockchain-based digital assets:

  • No refunds will be issued once a transaction has been confirmed.
  • We cannot cancel completed blockchain transactions.
  • You are solely responsible for ensuring you use the correct wallet address.
  • You are responsible for paying all applicable blockchain network fees.

4. Wallet Responsibility

You are solely responsible for:

  • Securing your wallet.
  • Protecting your recovery phrase.
  • Protecting your private keys.
  • Any activity conducted through your wallet.

BUDMO cannot recover lost wallets, stolen assets, forgotten passwords, or compromised accounts.

5. Digital Collectibles

BUDMO NFTs are intended as digital collectibles.

They are not:

  • Securities
  • Shares
  • Financial products
  • Investment contracts
  • Savings products

We make no representation or guarantee regarding future value, appreciation, resale prices, or investment returns.

6. Intellectual Property

Unless expressly stated otherwise, all artwork, branding, logos, website content, graphics, designs, trademarks, text, animations, and digital assets remain the exclusive property of BUDMO.

Ownership of an NFT grants ownership of that specific blockchain token.

Ownership of an NFT does not transfer ownership of BUDMO’s intellectual property.

NFT holders receive a non-exclusive license to display their purchased NFT for personal use, social media, and marketplace listings.

Commercial use requires prior written permission unless expressly permitted by BUDMO.

7. Community Guidelines

We strive to maintain a safe and respectful community.

We reserve the right to remove, suspend, or restrict access to our Services or community platforms if a user:

  • Attempts fraud.
  • Engages in scams.
  • Harasses other community members.
  • Shares malicious content.
  • Impersonates BUDMO staff.
  • Exploits bugs or vulnerabilities.
  • Violates applicable laws.

Such actions may result in permanent removal without prior notice.

8. Roadmap Disclaimer

Any roadmap, utility, partnership, product, feature, game, reward, staking system, raffle, marketplace integration, merchandise benefit, or future functionality described by BUDMO represents our current plans and intentions.

These plans may change, be delayed, modified, or discontinued at any time due to technical, regulatory, financial, operational, or other circumstances.

Nothing published by BUDMO constitutes a legally binding promise or guarantee of future development.

9. Merchandise Store

When purchasing physical products from our online store:

  • Delivery times are estimates only.
  • Shipping delays caused by carriers are beyond our control.
  • International customers may be responsible for customs duties or import taxes.
  • Returns and exchanges are accepted only in accordance with our Return Policy.
  • Personalized or limited-edition items may not be eligible for return.

Damaged items should be reported within seven (7) days of delivery.

10. Coupons and Promotions

BUDMO may offer promotional codes, discounts, NFT-holder rewards, or other promotional campaigns.

Unless otherwise stated:

  • Coupons cannot be exchanged for cash.
  • Coupons may expire.
  • Coupons cannot be combined unless specifically permitted.
  • We reserve the right to cancel or refuse any promotion that has been abused or obtained fraudulently.

11. Raffles, Giveaways, and Promotions

From time to time BUDMO may organize raffles, giveaways, contests, or promotional campaigns.

Participation may be subject to additional rules.

We reserve the right to:

  • Verify participant eligibility.
  • Disqualify fraudulent entries.
  • Modify or cancel promotions when necessary.
  • Select winners using methods determined by BUDMO.

Winner decisions are final.

We do not control these third-party services and are not responsible for their availability, security, or policies.

14. Limitation of Liability

To the fullest extent permitted by applicable law, BUDMO shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from:

  • NFT purchases
  • Cryptocurrency losses
  • Wallet compromise
  • Smart contract failures
  • Blockchain disruptions
  • Lost profits
  • Loss of digital assets
  • Service interruptions

Our maximum liability shall not exceed the amount paid by you directly to BUDMO for the relevant purchase.

15. No Warranty

Our Services are provided on an “AS IS” and “AS AVAILABLE” basis.

We make no warranties regarding:

  • Continuous availability.
  • Error-free operation.
  • Future compatibility.
  • Uninterrupted access.
  • Profitability or investment value.

16. Suspension or Termination

We reserve the right to suspend or terminate access to our Services without prior notice where we reasonably believe these Terms have been violated.

17. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction of Nigeria in which BUDMO is legally established, without regard to conflict of law principles.
